Can you skip VASAP? Hi, I’m Andrew Flusche, your Virginia DUI attorney. A lot of people are trying to figure out if you are charged with a DUI, are you going to have to do the VASAP class? That stands for the Virginia Alcohol Safety Action Program.

Unfortunately, if you’re convicted of a DUI or DWI in Virginia, VASAP is a requirement by law … To be sent to that class. Now, whether or not you have to do it immediately could depend. In a few rare and unique cases, sometimes the judge will basically order VASAP, but will not require that you do it as a condition of your suspended jail. Unfortunately, this typically happens in cases where the defendant is already incarcerated for some other reason, so you physically cannot do VASAP. Hopefully, that doesn’t apply to you.

Another situation that you have is sometimes people who might be deployed or might have other responsibilities where they simply cannot do the VASAP class or an equivalent, yet they’re still being found guilty of the DUI. IF there’s some kind of extenuating circumstances, the judge would still order VASAP, but you might not be required to do it right away. Now, the problem is that if you’re convicted of a DUI or DWI in Virginia, even if you’re not a Virginia resident, if you ever want to be able to drive in Virginia again, you’re going to need to have to do the VASAP class eventually. That is a condition of lifting the Virginia one-year license suspension. You have to do VASAP.

Basically, it’s very difficult to skip a VASAP all together, especially if you ever want to be able to drive in Virginia again. However, depending on your circumstances, there may be a way to try to make it work in your case so you can continue on with other responsibilities you have, at least for the time being. You might be able to come back to do VASAP at a later date, but usually you’re going to have to do VASAP, enroll right away, if you’ve been convicted of DUI or DWI in Virginia.
