Traffic Defense Requires Your Driving Record

Every week it seems like a client wants to know why I need their driving record for their traffic defense case. It’s simple. I need to know everything possible about you and the offense you’re charged with. Your driving record is an important piece of the picture.
There are two main reasons I need your driving record:
1. I need to know if you will qualify for certain results under the criteria used by different traffic judges. For example, some judges will only let you attend a driver improvement course to dismiss your traffic ticket if you have had a clean record for a set number of years. Without your driving record, I cannot know if I should even argue for driver improvement or similar options.
2. I have to know if your driving record is for us or against us. Virginia traffic judges will always want to see your driving record before sentencing. If your record is clean, that can be a powerful tool to obtain a lenient sentence. On the other hand, if your record is littered with traffic offenses, I will have to find a way to argue why the judge should not be hard on you for this charge.
