DWI Manslaughter

If you’ve been charged with DWI Manslaughter, it means that the police officer or prosecutor believe you were Driving While Intoxicated (DWI or DUI) and that another person unintentionally died as a result.

DWI Manslaughter is a Class 5 Felony

A Class 5 Felony is punishable by a term of imprisonment of not less than one year nor more than 10 years, or in the discretion of the jury or the court trying the case without a jury, confinement in jail for not more than 12 months and a fine of not more than $2,500, either or both.

Defenses for DWI Manslaughter

If you are charged with DWI Manslaughter, you need to hire an experienced lawyer. What was going on at the time of the crash? How did the accident occur? What happened when the police arrived? What about any toxicology blood or breath tests? These questions are just some of the reasons you need to hire an experienced attorney to examine potential issues.

Aggravated Involuntary Manslaughter

If the prosecution believes you drove in a way that might establish criminal negligence, you could be charged with Aggravated Involuntary Manslaughter.

Aggravated Involuntary Manslaughter is punishable by a term of imprisonment of not less than one nor more than 20 years, one year of which shall be a mandatory minimum term of imprisonment.

If you’re charged with this offense, your driving can make all the difference. Intoxication matters, but additional facts will be necessary to show criminal negligence. What was the speed limit? What were the road conditions? Was your vehicle in good working condition? Was your phone in the vehicle at the time of the crash? The police may seize your phone and your car. Investigations in these cases are often multifaceted and complex. You need to hire an attorney who has prosecuted these cases and understands them. This way you can explore potential issues and the best way to approach your case.
