Hello, I’m Andrew Flusche, you’re Virginia misdemeanor lawyer. A lot of people call me with shoplifting questions, wondering if they can have their charge for shoplifting dismissed. It’s a really good question, and something that we can talk about when you contact me about your case. In general, there’s two basic ways that we can have a charge for shoplifting dismissed to keep a conviction off your record. The first way would be if we could beat the charge, and that’s something that we could talk about, as far as what evidence there is against you, and can the commonwealth prove that you actually did shoplift.

The second way to have the case dismissed would be if you qualify for some type of first offender program or we could get some kind of other agreement worked out with the prosecutor. Those scenarios can be very complicated and so we’ll talk about those in another video. But in general, depending upon your record and the court you’re in, it may be possible to have your case dismissed, if you qualify for a first offender program, or some type of situation like that, some people call it diversion. It depends on the terminology the local court uses. But those are really the two basic ways to have your shoplifting case dismissed.

If you were to just to go to court by yourself, it’s a case where you could be facing the threat of jail time. So even if you think, “Oh, I didn’t do anything.
