Beat It: Passing a Stopped School Bus

In my passing a stopped school bus video, I talked about the legal flaw that can help beat these tickets. There are other ways to win as well, as illustrated by a recent King George case I handled.

My client was charged with passing a stopped school bus under the traffic infraction version of the law. Even though the offense occurred while the law still had a huge hole in it, we prepared the fight every element of the case.

When trial came, we plead not guilty. The deputy testified that a “school bus” stopped and my client passed it. She mentioned a couple other details, but not much.

I argued to the judge that the deputy hadn’t proven the case, since she didn’t establish all the key details as required by the law. Things such as the bus being yellow seem silly on one hand, but they’re critical points of the Commonwealth’s case.

Fortunately for my client, the judge agreed. He didn’t even have to rule on the complicated legal issue due to the messed up law. Case dismissed!
