What happens to your license if you are found guilty of a DUI second offense in Virginia? Let’s see. Hi, I’m Andrew Flusche, I’m your Virginia DUI lawyer and one question that comes up for people charged with DUI second offense in Virginia is what will happen to your license if you’re found guilty? Unfortunately, a second offense carries pretty severe punishments if you are convicted of it and one of those punishments is a three year loss of your license. For a first offense DUI in Virginia, you lose your license for one year, you can get a restricted license normally. For a second offense DUI, you do lose your license or your privilege to drive in Virginia for three years. The restricted license is much more limited as well. For a second offense within five years, you cannot get a restricted license for the first year, so that’s one year of no driving followed by two years of restricted driving if you’re eligible and the court will grant you an restricted license.
For a DUI second offense within ten years, so even if your second was ten full years ago, you would not be eligible for restricted license for the first four months of your suspension. It would be four months of no driving whatsoever followed by the remainder of the three years with a restricted license, again if the court grants you one. That’s definitely something you need to be aware of if you’re charged with a DUI second offense and quite honestly, you might want to start evaluating what transportation options you have. Now, there may be defenses to your charge and there may be defenses to the prior to maybe argue that it really isn’t a second offense.
