In general, a lane usage charge could imply a couple different types of issues. One can simply be that you’re accused of making some type of improper lane change.

If you’re accused of an improper lane change, the commonwealth has the burden of proving that you didn’t change lanes safely and therefore you may have an argument on that thought so the commonwealth may not be able to prove their case. One important issue is to note, that the officer might pull you over for not using a turn signal while changing lanes. However, Virginia law does not say you have to always use your turn signal. You only need to use your signal when traffic is affected by your maneuver. So, that could be one subtle defense to a improper lane change charge.

The other type of lane usage violation that occurs is when you have a CDL holder that is driving in the left lane of the interstate. If you are a tractor trailer driver who is simply in the wrong lane at the wrong time, there may be a way that we could negotiate your case down to a lesser offense to try to avoid having a moving violation in your driving record.

No matter what type of lane change charge or lane usage charge you have, you may be eligible to go to a driving school to have the case completely dismissed. This option isn’t available for CDL holders normally, however it is something that we can explore at every case.
