Trademark Cost for Federal Registration

The federal trademark registration process is much cheaper than you might think. It’s certainly worth the price for the protection that you get.
Initial filing fee
The filing fee for a federal trademark registration varies, depending upon the type of application you use and the trademark that you claim.
The cheapest application costs $275. To use this method, your application has to fit within the TEAS Plus form, and you must accept communication from the USPTO via email.
If you want to file online, but you cannot use the TEAS Plus form, you can pay $325. This is the basic online registration fee.
To file with paper, you have to pay a higher application fee. It will cost $375 to file this way. That is why I would strongly advise clients to use the online applications.
Unfortunately, the above fees are multiplied by the number of classes you claim for your trademark. If you are using the mark on clothing and food, you would claim two classes, thus doubling your filing fee.
Allegation of use
If you haven’t used your trademark in interstate commerce yet, you have to file what is called an “intent to use” application. When you actually use your trademark in interstate commerce, you then file a separate document with the USPTO, alleging that you have now used the mark. This costs $100.
Attorney’s fees
The cost for having an attorney assist with your trademark application can vary greatly. But it is wise to seek an attorney’s advice and assistance to make sure your trademark is properly filed.
